The Department of Homeland Security, through its enforcement division, Immigration and Customs Enforcements (ICE) has begun new enforcement efforts directed at employers. This has resulted in significantly increased administrative, civil penalties and criminal prosecutions resulting from violations. Employers must have all of their employees' documentation in order and be ready to respond to inquiries by ICE.
Employers are prohibited from knowingly hiring or continuing to employ unauthorized workers. All U.S. employers are responsible for verifying the identity and work authorization eligibility of all individuals, whether U.S. citizens or otherwise. To comply with the law, employers are required to complete an Employment Verification Form I-9 for all new employees hired after November 6, 1986.
